Terms & Conditions

Last updated: September 25, 2026

Welcome to PerryPerformFit. These Terms and Conditions ("Terms") govern your use of perryperformfit.com (the "Site") and the services offered by PerryPerformFit ("PerryPerformFit," "we," "us," or "our").

By accessing or using the Site, creating an account, purchasing a membership or training session, or otherwise using our services, you agree to these Terms and any additional agreements, policies, waivers, or disclosures applicable to the services you purchase. If you do not agree to these Terms, please do not use the Site or purchase our services.

1. About PerryPerformFit

PerryPerformFit provides personalized personal training services by connecting clients with qualified personal trainers based on factors such as goals, location, schedule, experience, training preferences, and trainer availability. Training may take place at a client's home, apartment or condominium fitness center, private gym, outdoor location, or another approved training location. Services may include individual training, partner training, memberships, single sessions, and other fitness-related services made available by PerryPerformFit from time to time. Availability of particular trainers, locations, session times, plans, or services is not guaranteed.

2. Eligibility

You must be at least 18 years old to independently purchase PerryPerformFit services. Individuals under 18 may participate only with the authorization of a parent or legal guardian and subject to any additional consent, waiver, or supervision requirements established by PerryPerformFit. You agree that the information you provide to PerryPerformFit is accurate, current, and complete.

3. Health and Participation

Physical exercise involves inherent risks, including the risk of injury. Before participating in training, clients may be required to complete health and safety questionnaires, informed consent documents, waivers, or other onboarding materials. You are responsible for providing accurate information regarding any injuries, physical limitations, medical conditions, medications, or other circumstances relevant to your safe participation in physical activity. PerryPerformFit and its personal trainers do not provide medical diagnosis or medical treatment. Information provided through the Site or during training is intended for general fitness and educational purposes and is not a substitute for advice from a qualified healthcare professional. Where appropriate, PerryPerformFit or a trainer may recommend that you obtain medical clearance before beginning or continuing an exercise program. If you experience chest pain, severe shortness of breath, dizziness, fainting, or other concerning symptoms during exercise, you should stop exercising and seek appropriate medical attention. Any separate informed consent, assumption-of-risk agreement, or liability waiver that you sign remains subject to its own terms.

4. Trainer Matching

PerryPerformFit personally matches clients with trainers using information such as the client's goals, location, schedule, experience, preferences, requested training style, and trainer availability.

Although we make reasonable efforts to identify an appropriate match, we cannot guarantee compatibility with a particular trainer or guarantee the availability of any specific trainer.

If you believe your trainer is not the right fit, you may request a trainer change. We will make reasonable efforts to identify another available trainer who better meets your needs.

Trainer availability may change because of scheduling, illness, relocation, termination of the trainer's relationship with PerryPerformFit, or other circumstances. If your trainer becomes unavailable, we will make reasonable efforts to provide another suitable trainer.

5. Memberships and Training Plans

PerryPerformFit offers training options that may include recurring memberships, single sessions, partner training, and other plans described on the Site or during enrollment.

The price, number of included sessions, session duration, billing frequency, and other material terms of your plan will be disclosed before purchase.

Unless expressly stated otherwise, recurring memberships automatically renew at the end of each billing cycle until canceled.

Before completing a recurring purchase, you will be shown the amount you will be charged, the frequency of the recurring charge, and instructions for cancellation.

PerryPerformFit will not impose undisclosed mandatory charges or fees.

6. Automatic Renewal and Billing

By purchasing a recurring membership and providing a valid payment method, you authorize PerryPerformFit and its authorized payment processor to automatically charge the applicable membership price and any properly disclosed applicable charges to your payment method at the beginning of each billing cycle until you cancel.

Your applicable renewal date and amount will be disclosed during enrollment and/or through your account or membership platform.

If your payment method fails, expires, or is declined, we may request an updated payment method and may temporarily suspend scheduling or services until payment is resolved.

PerryPerformFit may change membership pricing from time to time. Any price change affecting an existing recurring membership will be communicated as required by applicable law before the new price is charged.

7. Cancelling Your Membership

You may cancel a recurring PerryPerformFit membership at any time to stop future renewals.

Cancellation must be available through the method provided in your member account or another simple cancellation method made available by PerryPerformFit. If you experience difficulty cancelling, contact us at info@perryperformfit.com.

Unless applicable law requires otherwise, cancellation ordinarily stops your next renewal rather than terminating a billing cycle that has already begun.

If a recurring membership payment has already been processed, the membership ordinarily remains active through the remainder of that billing cycle, and remaining eligible sessions may be used before they expire.

Nothing in this section limits cancellation or refund rights that cannot legally be waived.

8. Massachusetts Cancellation Rights

To the extent a PerryPerformFit agreement constitutes a "contract for health club services" under Massachusetts law, Massachusetts consumers have additional statutory cancellation rights.

Massachusetts law currently provides a three-business-day cancellation period for covered health-club contracts and requires covered contracts to contain a specific cancellation notice.

Massachusetts law also provides additional cancellation rights in certain circumstances, including death, qualifying physical or medical disability lasting more than three months, certain discontinuation or substantial changes in services, and certain relocations.

Nothing in these Terms is intended to waive or restrict any cancellation, refund, or other consumer right provided by applicable law.

9. Pausing a Membership

Where offered, eligible memberships may be paused through the member portal or another method made available by PerryPerformFit.

The available pause period, effect on billing, session expiration dates, trainer availability, and resumption date may be subject to the terms displayed when the pause is requested.

Pausing a membership does not guarantee that the same trainer or recurring session time will remain available when training resumes.

10. Changing Your Plan

You may request to upgrade or downgrade your membership subject to plan availability.

Unless otherwise disclosed, changes generally take effect at the beginning of the next billing cycle.

Changes affecting the amount or frequency of recurring charges will be disclosed before they take effect as required by applicable law.

11. Scheduling, Rescheduling, and Missed Sessions

Training sessions are scheduled based on client and trainer availability.

Clients should provide at least 24 hours' notice when cancelling or rescheduling a scheduled training session.

A session cancelled with at least 24 hours' notice may be rescheduled subject to trainer availability and the applicable membership expiration rules.

Sessions cancelled with less than 24 hours' notice and missed sessions may be treated as used sessions and may not be eligible for rescheduling or refund.

PerryPerformFit may make reasonable exceptions for emergencies or extraordinary circumstances at its discretion.

If PerryPerformFit or your trainer cancels a scheduled session, the session will not be forfeited and reasonable efforts will be made to reschedule it.

12. Unused Sessions

Recurring memberships include the number of sessions associated with the plan purchased.

Unless the applicable plan expressly states otherwise, membership sessions must be used during the applicable billing cycle and do not roll over into a subsequent billing cycle.

Unused membership sessions ordinarily expire at the end of the applicable billing cycle. Single sessions do not expire, unless otherwise clearly disclosed at the time of purchase. If PerryPerformFit is unable to provide a purchased service, applicable credits, rescheduling, refunds, or other remedies will be handled in accordance with the applicable agreement and law.

13. Performance Flex or Fixed-Term Plans

If PerryPerformFit offers a multi-month or fixed-term plan such as Performance Flex, the specific term, number of sessions, payment terms, session expiration rules, cancellation rights, and renewal terms will be disclosed before purchase. Sessions permitted to carry forward within a fixed plan period expire at the conclusion of that plan period unless otherwise stated or required by law. A fixed-term plan will not automatically renew unless the automatic-renewal terms are clearly disclosed and the consumer provides any consent required by applicable law.

14. Partner Training

Partner training is intended for two participants training together. Each participant may be required to complete PerryPerformFit's onboarding, health screening, informed consent, and waiver documentation before participating. Scheduling, cancellation, and attendance policies applicable to partner sessions will be disclosed when the service is purchased.

15. Training Locations

You are responsible for ensuring that you have lawful permission to use the location selected for training, including any apartment, condominium, residential fitness center, private gym, outdoor space, or other third-party property. PerryPerformFit does not guarantee access to any third-party facility. Building rules, guest policies, access restrictions, insurance requirements, or other facility requirements may affect whether training can occur at a particular location. If access is denied or restricted, PerryPerformFit will work with you where reasonably possible to identify an alternative approved training arrangement.

16. Equipment

Trainers may use equipment already available at the training location and/or bring appropriate portable training equipment depending on the planned session. The equipment required will vary according to the client, trainer, program, location, and training goals. PerryPerformFit does not guarantee that every exercise or piece of equipment will be available at every location.

17. Payments

You agree to provide accurate and current billing information and authorize PerryPerformFit and its payment providers to process charges associated with services you purchase.

Prices and required charges will be disclosed before purchase.

Applicable taxes, if any, will be charged as required by law.

18. Refunds

Except where otherwise stated in a specific plan or required by applicable law, completed training sessions are non-refundable.

Late-cancelled or missed sessions treated as used under these Terms are ordinarily non-refundable.

Refund requests involving unused services will be evaluated according to the applicable plan terms and any rights provided by law.

Nothing in these Terms excludes a refund or cancellation right that applicable law requires PerryPerformFit to provide.

19. Accounts and Member Portal

Certain services may require an account with PerryPerformFit or a third-party platform used to administer memberships, scheduling, payments, or communications.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

Please notify PerryPerformFit promptly if you believe your account has been accessed without authorization.

20. Third-Party Services

PerryPerformFit may use third-party providers for services including scheduling, membership administration, payments, mobile applications, communications, background technology, or other business functions.

Your use of a third-party service may also be subject to that provider's applicable terms and privacy practices.

PerryPerformFit is not responsible for independent third-party websites or services except to the extent required by applicable law.

21. Privacy

Your use of the Site and PerryPerformFit services is also subject to our Privacy Policy.

Please review the Privacy Policy for information about how we collect, use, disclose, and protect personal information.

22. Electronic Communications

By using our Site or services, you agree that agreements, receipts, disclosures, notices, and other communications may be provided electronically where permitted by law.

Marketing emails and text messages, where applicable, are subject to separate consent and opt-out requirements. Agreeing to these Terms does not by itself constitute consent to receive marketing text messages where separate consent is required.

23. Intellectual Property

Unless otherwise indicated, the Site and its original content - including text, graphics, logos, branding, photographs, videos, design elements, training materials, and other content - are owned by or licensed to PerryPerformFit and are protected by applicable intellectual-property laws.

You may use Site content for personal, noncommercial purposes associated with your use of PerryPerformFit services.

You may not reproduce, distribute, modify, sell, publish, commercially exploit, or create derivative works from PerryPerformFit content without prior written authorization, except as permitted by law.

24. Acceptable Use

You may not use the Site:

  • For an unlawful or fraudulent purpose;
  • To interfere with the security or operation of the Site;
  • To attempt unauthorized access to accounts, systems, or data;
  • To transmit malicious software or code;
  • To impersonate another person;
  • To infringe the intellectual-property or other rights of PerryPerformFit or another party; or
  • In another manner that materially interferes with another person's use of the Site.

25. Disclaimer

PerryPerformFit does not guarantee any particular fitness, weight, body-composition, strength, health, or performance outcome. Results vary between individuals and depend on numerous factors, including participation, consistency, nutrition, sleep, health status, exercise history, genetics, and other circumstances. Information provided on the Site is for general informational and fitness purposes and should not be interpreted as individualized medical advice.

26. Limitation of Liability

To the fullest extent permitted by applicable law, PerryPerformFit will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Site. Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited, or to waive any right or remedy that cannot legally be waived.

27. Indemnification

To the extent permitted by law, you agree to indemnify and hold PerryPerformFit harmless from third-party claims, damages, liabilities, and reasonable expenses arising directly from your unlawful use of the Site, your material violation of these Terms, or your infringement of another person's rights.

This provision does not require you to indemnify PerryPerformFit for liability that cannot lawfully be transferred to you.

28. Termination or Suspension

PerryPerformFit may suspend or terminate access to the Site, an account, or services where reasonably necessary because of nonpayment, fraudulent activity, threatening or abusive conduct, safety concerns, material violations of these Terms, or unlawful use of the services. Termination does not eliminate rights or obligations that accrued before termination. Any refund or continuing payment obligation will remain subject to applicable law and the terms of the applicable service agreement.

29. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, business practices, technology, or applicable law. The "Last updated" date at the top of this page indicates when these Terms were most recently revised. Material changes affecting an existing recurring membership will be communicated where required by applicable law. Changes will not retroactively eliminate rights that have already accrued.

30. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where federal law or another applicable law provides otherwise. Nothing in these Terms limits rights available to consumers under applicable consumer-protection laws.

31. Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

32. Entire Agreement

These Terms, together with any applicable membership agreement, informed consent, waiver, Privacy Policy, and other terms expressly incorporated into your purchase or participation, constitute the applicable agreement between you and PerryPerformFit concerning the relevant services. If a specific signed service agreement conflicts with these general website Terms regarding the purchased service, the specific service agreement will control to the extent permitted by law.
